The terms that govern your use of this website and the wider HALP network.

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the websites, platforms and services operated by House And Land Packages Pty Ltd (ABN 92 631 641 408) ("HALP", "we", "us", "our"), including this website and all associated websites within the HALP network.

By accessing or using our services you agree to be bound by these Terms. If you do not agree, you must not use our services.

2. About Our Services

HALP operates property information, search and referral platforms. Through our services we:

Publish information about residential land estates, precincts, developments and house and land packages
Publish planning, demographic, school, transport and lifestyle information relevant to those locations
Connect interested buyers with developers, builders, agents and mortgage brokers
Provide business directory and advertising services to property industry participants

We are an information and referral service. We are not the vendor of any property, we do not act as your agent, and we do not provide legal, financial, taxation or credit advice.

3. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use our services. By using our services you represent that you meet these requirements.

4. Accounts and Registration

Where an account is required, you agree to:

Provide accurate, current and complete information
Keep your login credentials confidential
Notify us promptly of any unauthorised use of your account
Accept responsibility for all activity that occurs under your account

We may suspend or terminate an account that we reasonably believe has been used in breach of these Terms.

5. Information Accuracy and No Reliance

Information published on our websites is provided in good faith and for general information purposes only. It is sourced from developers, builders, agents, government agencies, planning authorities and publicly available data, and may include modelled or estimated figures.

You acknowledge that:

Precinct plans, staging, lot yields, road and rail projects, school sites and community facilities are subject to change by the relevant authorities and may be delayed or may not proceed
Images, renders, plans and maps are indicative only and are not to scale
Prices, availability, inclusions and specifications are set by third parties and may change without notice
Statistics marked "Estimated" or "Modelled" are indicative only and are not a valuation, forecast or guarantee
School catchments, zoning and planning controls change and must be independently verified

You must make your own enquiries and obtain your own independent legal, financial and professional advice before making any property or finance decision. To the maximum extent permitted by law, we disclaim liability for any reliance placed on information published on our websites.

6. Third-Party Content and Links

Our services contain content supplied by third parties and links to third-party websites. We do not control and are not responsible for third-party content, products, services or privacy practices. Inclusion of a listing, business or link is not an endorsement or recommendation.

Any dealings between you and a third party, including any purchase, contract, or engagement, are solely between you and that third party.

7. Enquiries and Referrals

When you submit an enquiry about a listing, your details may be passed directly to the relevant developer, builder, agent or broker so they can respond to you. That party is then responsible for its own handling of your information. Our collection and handling of personal information is described in our Privacy Policy.

We may receive a referral fee, commission or advertising fee from third parties to whom we refer enquiries. This does not affect the price you pay.

8. Home Loan and Finance Information

Finance-related content, calculators and enquiry forms are provided for general information only and are not credit advice or an offer of credit. Any indicative figures are estimates that do not take into account your objectives, financial situation or needs. Credit is subject to lender assessment, criteria, fees and charges.

9. Advertising and Business Listings

If you advertise or list a business with us, you additionally warrant that:

You are authorised to publish the content you supply
All content is accurate, lawful and not misleading or deceptive
You hold all licences, registrations and insurances required for your services
Your content does not infringe any third-party intellectual property or other rights

You grant us a non-exclusive, royalty-free licence to host, reproduce, adapt for formatting, and publish your content across the HALP network for the term of your listing. We may edit, decline, suspend or remove any listing at our discretion. Advertising fees are payable in accordance with the applicable listing agreement or invoice and are non-refundable except where required by law.

10. Acceptable Use

You must not:

Use our services for any unlawful, fraudulent or misleading purpose
Scrape, harvest, index, crawl or copy content except as permitted by our robots.txt or with our written consent
Republish, resell or commercially exploit our content without our written consent
Interfere with, probe, overload or attempt to gain unauthorised access to our systems
Upload malicious code or attempt to circumvent security or access controls
Submit false, misleading or another person's personal information
Use our contact forms or directory data for unsolicited marketing

11. Intellectual Property

All content on our websites, including text, layout, design, graphics, logos, maps, charts, code and compilations, is owned by or licensed to HALP and is protected by Australian and international copyright and trade mark law.

You may view, download and print content for your own personal, non-commercial use. All other use requires our prior written consent.

12. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.

Where liability can be limited, our liability for breach of a consumer guarantee is limited, at our option, to resupplying the service or paying the cost of having the service resupplied.

13. Disclaimers and Limitation of Liability

To the maximum extent permitted by law:

Our services are provided on an "as is" and "as available" basis without warranties of any kind
We do not warrant that our services will be uninterrupted, error-free or free of harmful components
We are not liable for any indirect, incidental, special, consequential or economic loss, loss of profit, loss of opportunity or loss of data arising from your use of our services
Our total aggregate liability arising out of or in connection with our services is limited to the amount you have paid to us (if any) in the 12 months preceding the claim

14. Indemnity

You indemnify HALP, its officers, employees and contractors against any claim, loss, liability, cost or expense arising from your breach of these Terms, your misuse of our services, or your infringement of any third-party right.

15. Privacy

Our collection, use and disclosure of personal information is governed by our Privacy Policy, which forms part of these Terms.

16. Suspension and Termination

We may suspend, restrict or terminate your access to our services at any time, with or without notice, where we reasonably consider you have breached these Terms or where necessary to protect our services or other users. Clauses that by their nature should survive termination will survive.

17. Changes to These Terms

We may update these Terms from time to time. The updated version takes effect when published on this page. Your continued use of our services after publication constitutes acceptance of the updated Terms.

18. Governing Law

These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the courts competent to hear appeals from them.

19. General

If any provision of these Terms is found invalid or unenforceable, it is severed and the remaining provisions continue in force. A failure by us to enforce a provision is not a waiver of that provision. These Terms, together with our Privacy Policy and any applicable listing agreement, constitute the entire agreement between us.
